Administrative Court suspends mandatory child vaccination in Costa Rica

 The Appellate Administrative Court of San José (Tribunal de Apelaciones Contencioso Administrativo y Civil de Hacienda de San José) granted an injunction filed by attorney Arcelio Hernandez Mussio against mandatory Covid-19 vaccination for children under the age of 12. The main arguments were that there is currently no formal approval for children under 12 to receive the pediatric vaccine from the FDA, nor a local registration of the pharmaceutical product in Costa Rica. The decision is number 439-2022-I dated December 8, 2022 and shall remain in place until there be a final decision on the merits of the case. The court considered a potential serious risk to the health of this vulnerable population, key to the survival of future generations.
